Hitherto, there used to be a conflict between the Federal High Court and the National Industrial Court in terms of their jurisdictions. However, the case was laid to rest though unfortunately resurrected after a military junta. This article seeks to analyse the constitutional framework for the jurisdiction of the Federal High Court (FHC) and also to highlight the expansion of the jurisdiction of the National Industrial Court (NIC), especially, in trade dispute resolutions beyond the provisions of the Trade Disputes Act.
The struggles for the control of material values in the process of production have given rise to the emergence of two main classes in society. Though classes are formed at the level of production, the struggle between different classes revolve around the organization of power as they seek to dominate one another (Nnoli: 2003). The dominant class emerges to protect and guard a particular mode of production and mediate and moderate inter-class and intra-class struggles in order to maintain stability.
After the nation’s 13½ -year cycle of military dictatorship, Nigeria returned to democracy in 1979. Social scientists might differ in their definitions of democracy, but the valid factors and determinants of true democracy have new been in dispute. These are majority rule and electoral process.
In more recent time the advent of John Rawls’ political philosophy has become an epoch-making. It has indeed drawn attention from different quarters. Rawls tried to formulate a workable formula of ‘fair’ equal distribution of rights and liberties of individuals and the method of distributing socio-economic benefits that will cover income, health, education, and other political rights.
